WAIVER, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT WHEREAS, Evona Poplawski (“Owner”) owns that certain real property located in Sarasota County more particularly described as 4490 Riverwood Ave, Sarasota FL 34231 (the “Premises”). WHEREAS, there is a residential swimming pool (“Pool”) located on the Premises. WHEREAS, the undersigned seeks to rent the Premises from Owner for a period beginning on the rental day of and ending on the R (the “Rental Term”). NOW, THEREFORE, in consideration for being allowed to occupy the Premises with the right to use the Pool during the Rental Term, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned does hereby acknowledge and agree to the terms and conditions set forth in this Waiver, Release of Liability and Indemnity Agreement (the “Release”): Assumption of the Risk. The undersigned acknowledges and agrees that there are inherent risks associated with the Pool, including drowning and near drowning incidents with the potential to result in injury, death, or other serious or life-threatening medical conditions; falls on hard surfaces around the Pool perimeter; physical exertion which may result in injury or an adverse medical condition; property damage; and other inherent risks which are impractical and unnecessary to identify in this Release. The undersigned hereby voluntarily accepts and assumes all risks associated with the Pool, whether known or unknown, whether disclosed or undisclosed. The undersigned further accepts and assumes all responsibility for following proper pool safety procedures, controlling access to the Pool and supervising use of the Pool by any and all persons during the Rental Term. Waiver and Release. The undersigned on behalf of himself/herself, and on behalf of his/her spouse, heirs, assigns, personal representatives, guardians, executors, administrators, agents, representatives, next of kin, invitees, guests, and/or licensees hereby forever waives, releases, discharges and agrees to hold harmless Owner, and Owner’s employees, agents, contractors, representatives, successors and assigns, from and against any and all claims, injuries, demands, actions, causes of action or liability arising out of or relating to the Pool, including claims for the negligence of Owner or the negligence of Owner’s employees, agents, contractors, representatives, successors and assigns. Indemnification. The undersigned and the undersigned’s spouse, heirs, assigns, personal representatives, guardians, executors, administrators, agents, representatives, next of kin, invitees, guests, and/or licensees hereby agree to indemnify, save and hold harmless Owner, and Owner’s employees, agents, contractors, representatives, successors and assigns, from any and all loss, liability, costs, expenses, claims, demands or lawsuits arising out of or relating to the Pool, including claims for the negligence of Owner or the negligence of Owner’s employees, agents, contractors, representatives, successors and assigns. Choice of Law. The undersigned hereby acknowledges and agrees that this Release shall be governed by the laws of the State of Florida. In the event a lawsuit is filed to enforce the terms of this Release, venue shall be in Sarasota County, Florida. Severability. In the event any provisions hereof should be declared by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason whatsoever, such illegality, unenforceability, or invalidity shall not affect the remainder of this Release. Representations. By signature below, the undersigned hereby represents and warrants that (1) the undersigned has read, understands and accepts the terms of this Release; (2) the undersigned has not relied on any statement or representation not contained in this Release in executing the Release; (3) the undersigned is aware that he/she is waiving legal rights by executing this Release; (4) the undersigned has executed this Release for full, adequate and complete consideration fully intending to be bound by same; (5) the undersigned has executed this Release voluntarily as his/her own free act and deed; and (6) it is the undersigned’s irrevocable intention to bind himself/herself and his/her spouse, heirs, assigns, personal representatives, guardians, executors, administrators, agents, representatives, next of kin, invitees, guests, and/or licensees to the terms set forth in this Release.
